1. Introductory provisions
- These terms and conditions govern the rights and obligations of the provider and the user (the “customer” or “you”) when using the website petposed.com (the “service”) and when buying digital portraits.
- From photos uploaded by the customer, the service uses artificial intelligence to create new digital images (the “portraits”). A portrait is digital content not supplied on a tangible medium (Section 2389a et seq. of Czech Act No. 89/2012 Coll., the Civil Code).
- If the customer is a consumer, the relationship is governed, in addition to these terms, by the consumer protection rules that apply to them and that cannot be waived to their detriment. The contract can be concluded in English.
2. How the service works
- The customer chooses up to 12 portrait styles and uploads photos. No registration or payment card is needed.
- We create the first three chosen styles for free as a preview in lower resolution with a watermark. The preview is a free sample; it does not give you the right to use the image without the watermark.
- After payment, we make the chosen portraits available for download in high resolution without a watermark. Styles that have not been previewed yet are created after payment, usually within a few minutes.
- The portraits are available via a unique link, which you will see in your browser’s address bar once the previews are created. Save the link and keep it safe – anyone who has it can see your portraits. If you lose the link, our support team can find it for you.
3. Uploaded photos
- You may only upload photos to which you hold the necessary rights and with the consent of all people shown in them. For persons under 16, consent must be given by a parent or legal guardian.
- It is prohibited to upload photos that violate the law or the rights of third parties, that show nudity, violence or minors in an inappropriate context, or that are used to create misleading content about a real person.
- The customer is responsible for the content of the uploaded photos. If these rules are violated, the provider may cancel the order and delete the data.
4. Price and payment
- The first portrait in an order costs $19, and each additional one costs $9. Prices are final and include any applicable VAT. This is a one-time payment, not a subscription.
- Payment is made online through the Stripe payment gateway (card, Apple Pay, Google Pay). The contract is concluded at the moment of successful payment. Stripe sends the receipt to the email address entered during payment.
5. Delivery and regeneration
- We deliver the portraits electronically by making them available for download on the order page, usually within a few minutes of payment.
- For each purchased portrait, you get 2 free regenerations. A new attempt replaces the previous version, so download the version you like first.
- The portraits are created by artificial intelligence. The result is an artistic interpretation and may not be completely faithful to the original (e.g. details of clothing, background, minor features). This in itself is not a defect.
- We keep purchased portraits available for download for 30 days from payment, after which we delete them. Please download them before then.
6. Rights to the portraits
- You may use purchased portraits without limitation for personal purposes – print them, share them on social media, give them as a gift. For commercial use (e.g. advertising, selling products featuring the portrait), please contact us.
- Watermarked previews are only for deciding whether you want to buy the portrait.
- The sample style images on the website are illustrative and created by artificial intelligence; they do not show real customers.
7. Right of withdrawal
- As a consumer, you have the right to withdraw from the contract without giving any reason within 14 days of its conclusion, i.e. of payment. The deadline is met if you send your notice of withdrawal within this period.
- Under the EU Consumer Rights Directive (2011/83/EU) and comparable laws (for example in the EEA and the United Kingdom), the right of withdrawal for digital content not supplied on a tangible medium is normally lost once supply has begun with the consumer’s express consent and acknowledgment that the right of withdrawal is thereby lost. By paying, you expressly request that the portraits be created and made available immediately. Nevertheless, we let you withdraw within the period stated in point 7.1.
- You can withdraw by any clear statement, most simply by email to [email protected] with your order number or a link to the order. Template (optional): “I hereby give notice that I withdraw from the contract for the supply of portraits, order no. …, date of payment …, first and last name …”, sent to the email address above or to UnknownHorizons s.r.o., Na Folimance 2155/15, 120 00 Praha 2 – Vinohrady, Czech Republic.
- We will refund the price paid without undue delay, and no later than 14 days after receiving your notice of withdrawal, using the same payment method you used. After withdrawal, you may no longer use the portraits or make them available to third parties.
- If, for technical reasons, we cannot deliver a portrait at all, we will refund the full price paid for it, even without withdrawal.
8. Defects and complaints
- If you believe a portrait is defective (e.g. it cannot be downloaded, is damaged, or clearly does not match the chosen style or the uploaded photos), first use a regeneration, or email us at [email protected] with a link to the order.
- We will handle your complaint without undue delay, and no later than within 30 days. Depending on the nature of the defect, we will create the portrait again or refund the price or a reasonable part of it.
9. Out-of-court dispute resolution
The body competent for out-of-court resolution of consumer disputes is the Czech Trade Inspection Authority (Česká obchodní inspekce), Štěpánská 567/15, 120 00 Prague 2, Czech Republic, adr.coi.cz. Consumers in the EU/EEA can also contact the European Consumer Centre in their country (ECC-Net), which helps with complaints against traders in other EU/EEA countries. The provider’s compliance with its obligations is supervised by the Czech Trade Inspection Authority and, in the area of personal data, by the Czech Office for Personal Data Protection (Úřad pro ochranu osobních údajů).
10. Final provisions
- We describe how we process personal data in our privacy policy.
- The provider may change these terms. Contracts already concluded are governed by the version in effect at the time of their conclusion.
- Matters not covered by these terms are governed by the laws of the Czech Republic. This choice of law does not deprive a consumer of the protection afforded by the mandatory provisions of the law of the country of their habitual residence.
